Consult the Department of Insurance

Each state has an insurance commissioner that works through the Department of Insurance. In order for a complaint to be correctly handled, there needs to be documentation of the complaint. This means that a consumer needs to get the proper forms from the department in order to have them filed to begin an investigation. Some states have these documents online; others require that the person requests them by phone and they can either be faxed or sent to the person via first class mail.

When filling out the necessary forms, it is a good idea to do a rough draft and take your time when filling out the form so that relevant information is not left out. Review it and ask yourself, does this tell the entire story and would a neutral third party read this form and decide to take action and investigate my claim? Insurance department employees read many complaint forms every day so it is important to be thorough so that there is a higher likelihood of the form being processed quickly and investigated.

Make Copies of Relevant Documents

Because an insurance claim was denied, there needs to be documentation showing that the insurance company should have paid out money for the automobile insurance claim. Make photocopies of all of the correspondence between you and your auto insurance company. This helps the investigators examine the evidence and make a determination on whether misconduct took place.

Be a Patient Person

When dealing with the Department of Insurance you have to be patient. Call after three to four weeks and make sure that the office received your complaint forms. Also ask to speak to a representative to ask if any progress has been made on the case. Most of the time individuals that file insurance complaints get something in the mail after four to six weeks documenting that their documents were received and that a case has been opened.
